Information Support of Procedural Activities to Prove Moral Damage in Pre-Trial Proceedings

Abstract


In this article, the authors study of the procedure for establishing the facts of causing moral harm by criminally punishable acts in pre-trial criminal proceedings. It has been proved that the investigator and the person conducting the initial inquiry ought to explain to the victim the right to file a civil action and take measures to ensure further compensation, as well as explain the ways of confirming the stated claims. The authors consider the various methods and criteria used in assessing moral damage caused by crimes and discuss the importance of documenting the facts of causing this type of harm. The authors substantiate the conclusion about the need for mandatory documentary evidence of moral damage caused by crimes. At the same time, the most important argument in this aspect is the activity of the investigator and the person conducting the initial inquiry to prove the facts of moral damage caused by the crime by attaching the documents substantiating the claim to the criminal case files, which in turn creates legal prerequisites for the court to award specific sums of money that correlate with the consequences of the harm caused to the victim
